Heard learned counsel for the petitioner and Sri Gyanesh Kumar Mishra learned counsel holding brief of Sri K.M. Asthana for the respondents.
The petitioner has been dismissed from service. That order has come to be affirmed by the appellate authority. It is however contended that Clause 45(i) of the 11 Bipartite Settlement which applies, confers a right on the petitioner to seek reconsideration of the order passed by the appellate authority by moving an appropriate representation before the authority higher than the appellate authority. The Court is apprised that in the present case it is the Chief Manager who will be the competent authority to decide the representation of the petitioner stated to have been made pursuant to the provisions made in clause 45(i).
In view of the aforesaid, this petition shall stand disposed of with a direction that subject to the petitioner filing a duly authenticated copy of this order alongwith a copy of the writ petition and its enclosures before the competent authority within a period of two weeks from today, all endeavour shall be made to dispose of the same in accordance with law and preferably within a period of three months therefrom.
All contentions of respective parties on merits are kept open.
