Heard Sri Shailesh Kumar, learned counsel for the petitioners, learned Standing Counsel who represents respondent nos.1 to 6 and perused the record.
Present petition has been filed by the petitioners with the prayer as mentioned below:-
"(a) Issue a writ order or direction in nature of Mandamus commanding and directing the respondents to make measurement of Chak No.149, situated in village Molanapar, Pargana Anguli, Tehsil Shahganj, District Jaunpur, in pursuance of the order dated 09.06.2020 passed by respondent no.3."
It is submitted by learned counsel for the petitioners that in provisional consolidation scheme petitioners have been proposed the Chak No.149.
It appears that with respect to disturbance in their allotted Chak petitioners have moved representation dated 09.06.2020 before D.D.C.(Respondent No.2). On the aforesaid application D.D.C. has passed order dated 09.06.2020, directing A.C.O. for taking suitable action.
It is submitted that despite the aforesaid direction, till date no steps have been taken to ventilate the grievance of the petitioners and aforesaid representation dated 09.06.2020 is still pending for disposal.
In this conspectus as above, no useful purpose would be served to keep this matter pending, therefore, this court deems it appropriate to finally dispose of the present writ petition, without making any observation on the merits of the case as mentioned in the present writ petition, with a direction to Deputy Director Consolidation, Jaunpur (respondent No.2), before whom representation dated 09.06.2020 is pending disposal to either decide the same himself or direct the authority concern to take appropriate decision, under the relevant provisions of law as applicable, expeditiously, preferably, within the period of three months from the date in receipt of copy of this order.
It is expected that it should be decided by reasoned and speaking order, in accordance with law, after affording opportunity of hearing to the parties concerned without granting unnecessary adjournments.
The petitioner shall file computer generated copy of such order downloaded from the official website of High Court, Allahabad supported by an affidavit, which shall be verified by the concerned authority from the website of the High Court, Allahabad.
With the aforesaid observation, present writ petition is disposed of.
