(Per : HONOURABLE MR.JUSTICE RAVI R.TRIPATHI) Though the matter was adjourned to 30.04.2012, on 11.04.2012, to enable the learned APP to effect service to the opponent, the matter is mentioned by the learned APP, as in response to the service of process of this Court, the learned APP has come to know that Sabarmati Police Station had already sent communication dated 08.04.2012 to the Section Officer, Office of the Government Pleader, High Court of Gujarat, intimating that the opponent in Criminal Appeal No.824 of 1993-Gurudevsinh Ronaksinh Sardar (Rajput), resident of Laxminagar Nursery, Motera, Sabarmati, is declared to have died on 18.01.2012. This declaration is given by the son of the opponent named Mehendrasinh Gurjdevsinh Sardar. In support of the said declaration, son of the opponent has produced xerox copy of the death slip issued by Civil Hospital, Ahmedabad.
Learned APP places on record copies of communication dated 08.04.2012 and death slip.
In view of that, the appeal stands abated. The same is disposed of accordingly.
