Learned AGP Ms.Pathak places on record copy of a communication dated 12th January 2012 along with xerox copy of a cheque drawn in favour of the original petitioner for the sum of Rs.5,95,715=00 towards his retiral dues.
Ms.Pandya, learned advocate appearing for the original petitioner confirms that this particular amount has been credited in the account of the original petitioner. She states that the judgment of this Court has been complied with substantially in its letter and spirit. However, there is some objection as regards the pay fixation as it was to be calculated from the year 1964. She has also clarified that the amount which has been accepted by the petitioner has been accepted without prejudice to his rights and contentions so far as this pay fixation aspect is concerned.
In future if any problem crops up in this regard, it will be open for the petitioner to agitate the same. However, no further orders are necessary to be passed so far as the main petition is concerned i.e. Special Civil Application No.5356 of 2001.
These proceedings are accordingly closed.
