1. In response to the fresh process issued by this Court on 16.4.2012, learned APP Mr L R Pujari by filing affidavit of service of notice, places on record the fact that the sole respondent - Brahman Nanji Karsan has expired. In support of the said statement, a statement of Manishankar Kalyanjibhai Bharad (Dave) is enclosed wherein it is stated that this Brahman Nanji Karsan has expired about 10 years back. In view of the aforesaid fact, the appeal stands abated. The same is disposed of accordingly. Notice is discharged.
