(Per : HONOURABLE MR.JUSTICE JAYANT PATEL) The present application is for leave to prefer appeal against the judgment and order passed by the learned Sessions Judge in Sessions Case No. 72/2009, whereby, the accused have been acquitted for the offences under section 302, 120(B), 34, 201 of IPC read with section 3(1)(10) and 3(2)(5) of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocity) Act, 1989, read with section 135 of the Bombay Police Act.
Considering the facts and circumstances, leave deserve to be granted, therefore, granted. The application is disposed of accordingly.
