(Per : HONOURABLE MR.JUSTICE RAVI R.TRIPATHI) Learned Additional Public Prosecutor Mr.L.R. Pujari placed on record communication received from Thasra Police Station intimating that accused-Desaibhai M. Machhi has expired on 18th May 2011. Along with the said communication a statement of one Raijibhai Motibhai Machhi is enclosed. Said Raijibhai has stated that his younger brother, Desaibhai M. Machhi has expired before nine months. Along with the communication death certificate dated 1st February 2012 issued by Talati-cum- Mantri, Gram Panchayat, Sonipur, Taluka Thasra is also enclosed. The same is taken on record.
2. In view of the death certificate of the respondent- accused, the matter stands abated. The Criminal Appeal is disposed of accordingly. Bailable warrant issued against the deceased-accused stands cancelled.
