(Per : HONOURABLE MR.JUSTICE RAVI R.TRIPATHI) The matter is listed with office submission bringing it on record that respondents no.2 and 4 have died. Death certificates of Bhavanbhai Bhagabhai, respondent no.2 herein and Ranchhhod Raja Makwana, respondent no.4 herein are enclosed.
On perusal of memo of appeal it is noticed that memo of appeal bears incorrect name of respondent no.2. What is mentioned in the memo of appeal is Satwara Bhavan Jaga, and not Satwara Bhavan Bhagabhai. Besides, the death certificate does not bear the surname.
So far as respondent no.4 is concerned the name mentioned in the appeal memo is Satwara Ranchhod Raja, which tallies with the name mentioned in the judgement, but the certificate bears the name Ranchhod Raja Makwana. So there is discrepancy in the name of respondent no.4 also.
2. Learned Additional Public Prosecutor Mr.Pujara seeks permission to correct the name of respondent no.2. The learned APP seeks time to get the contents of the death certificate verified. Permission is granted. In light of the fact that respondents no.2 and 4 are alleged to have expired on 19th October 1992 and 30th April 2006 respectively, the learned APP is granted time to take instructions with regard to 'surname' of respondent no.4 is concerned.
The learned APP seeks a week's time to collect the correct Paper Book as the Paper Book furnished to him is of some other matter though the title page of the Paper Book is of the present appeal. S.O. to 23.04.2012 (RAVI R. TRIPATHI, J.) (G.B.
