(Per : HONOURABLE MR.JUSTICE RAVI R.TRIPATHI) The present appeal is filed by the State of Gujarat being aggrieved by judgement and order dated 21st May 1992 passed by the learned Additional Sessions Judge, Mehsana in Sessions case No.36 of 1992, whereby the learned Judge was pleased to record acquittal of the offence under section 302 of the Indian Penal Code.
2. Learned Additional Public Prosecutor Mr.L.R. Pujari places on record a xerox copy of communication dated 7th March 2012 received from the Police Inspector, Patan Taluka Police Station. A copy of Death Certificate dated 23.12.2009 in respect of Patel Amritbhai Mohanlal issued by the Gram Panchayat is enclosed with the said communication. The respondent- accused has died on 18th May 2009.
3. In view of the above the Criminal Appeal stands abated. The same is disposed of accordingly. Bailable warrant issued against the respondent-accused stands cancelled.
