Heard learned counsel for the parties. This is an appeal filed by the State.
The issue involved in this appeal is settled by a decision of this Court in another Special Appeal Defective No.708 of 2016 of the State vide judgment and order dated 19.11.2018.
The present appeal is also decided in the same terms.
The special appeal fails and is dismissed. The order of the learned Single Judge is upheld.
