Learned counsel for the opposite party nos. 1, 2 and 3 have no objection with regard to condonation of delay in filing the present Criminal Appeal filed by the State.
Delay in filing the revision is condoned. Delay condonation application is allowed.
Heard Sri J.P.Tripathi, learned A.G.A. and Sri Shukla, learned counsel for the opposite party nos. 1,2 and 3 and perused material on record.
Sri J.P. Tripathi, learned A.G.A. pointed out that the present revision has been filed against the order dated 09.11.2020 by which after committal under Sections 323,504,506 332, 353 and Section 307 of Indian Penal Code, case was sent to the C.J.M. Rampur by the Special Judge, S.C./ S.T. Act/ Additional Sessions Judge, Rampur for trial under Sections323, 504, 506 I.P.C. after considering the prayer for discharge and held the offence under 332, 353, 307 I.P.C. is not made out.
Sri Sushi Shukla, learned counsel for the opposite party nos. 1, 2 and 3 pointed out that in the aforesaid case, judgment convicting the accused persons has been passed on 08.03.2021, certified copy of the said judgement is annexed as C.A.1 to the counter affidavit.
In view of above, prayer for quashing the impugned order dated 09.11.2020 has become infructuous.
Consequently, Criminal revision is dismissed as infructuous.
The party shall file computer generated copy of such order download from the official website of High Court Allahabad or certified copy issued from the Registry of the High Court, Allahabad.
The concerned Court/Authority/Official shall verify the authenticity of such computerized copy of the order from the official website of High Court Allahabad and shall make a declaration of such verification in writing.
