Heard Sri Ghanshaym Kumar learned AGA assisted by Sri S.M. faraz Kazmi and perused the record.
By means of the present government appal the learned AGA has challenged the judgment and order dated 05.09.2018 passed by IInd learned Additional District & Sessions Judge/Fast Track Court, Amroha by which the respondent nos. 1 to 7 were acquitted in S.T. No. 279/ 2013 under section 306 IPC.
I have gone through the judgment and find that the marriage of deceased was solemnized with Nasir, respondent no. 1 about 14 years back. The deceased was suffering from psychogenic disease and she was a psychic patient and under going treatment, living under depression. There is no whisper of dowry or the harassment.
Under the circumstances, I fine no good reason in judgment and order passed by IInd Additional District & Sessions Judge/F.T.C., Amroha.
Hence, the present government appeal stands rejected. Order Date :- 19.12.2018 Nisha
