Application for bail under Sec.439 of Cr.P.C. 2. Petitioners are accused nos.2 and 3 in Crime No.1093 of 2014 of Ezhukone Police station registered for offences punishable under Secs.294(b), 323 and 308 read with Sec.34 of IPC and Sec.27 of Arms Act.
3. Prosecution case is that on 11.09.2014 at 6 p.m., the accused persons attacked the defacto complainant with an intention to kill him. The 1st accused attacked him with a sword and other accused beat him with hands.
4. Heard the learned counsel for he petitioners and the learned Public Prosecutor.
5. Learned counsel for the petitioners submitted that they were arrested on 12.09.2014. All the allegations of serious nature are only against the 1st accused.
6. Learned Public Prosecutor opposed the bail application.
7. Considering the nature of allegation and the date of arrest, bail is granted to the petitioners with the following conditions.
i. The petitioners shall be released on bail on their executing bond for Rs.25,000/- (Rupees twenty five thousand only) each with two solvent sureties each for the like sum to the satisfaction of the Judicial First Class Magistrate Court-I, Kottarakkara.
ii. The sureties shall produce documents to establish their identity and solvency.
iii. The petitioners shall report before the investigating officer on all Saturdays between 9.00 a.m. and 10.00 a.m. until final report is filed.
iv. The petitioners shall not intimidate or influence the witnesses or meddle with the investigation.
v. The petitioners shall not involve in any other crime during the pendency of this case.
vi. The petitioners shall co-operate with investigation of the case.
vii. If any one of the above conditions is violated by the petitioners, the Magistrate is free to cancel the bail.
