1. Heard the learned Additional Public Prosecutor Mr. K. L. Pandya for the applicant and learned advocate Mr. Harshil C. Dattani for the respondent.

Present application under Section 5 of the Limitation Act has been filed for condonation of delay of 99 days, caused in filing the criminal appeal against the judgment and order of acquittal dated 06/02/2012, passed in Special (Atrocity) Case No. 22 of 2010, by the learned Special Judge and Additional Sessions Judge, Khambhalia.
3. The delay of 99 days, caused in filing the Appeal, has been sufficiently and satisfactorily explained in the application, more particularly in Para 3 and 4. Considering the same, present application is allowed and the delay caused in filing the appeal is condoned. Rule is made absolute accordingly.
