S.Sivagami vs Mr.M.Karunakaran

Madras High Court|09 June, 2017

JUDGMENT / ORDER

These Contempt Petitions have been filed alleging disobedience of the order and direction issued in W.P.(MD) Nos.10965 and 10966 of 2011 dated 26.09.2011.
2.The learned Special Government Pleader produced before this Court the proceedings of the District Collector dated 30.10.2014 and submitted that the order of this Court dated 26.09.2011 has been complied with.
3.The learned counsel appearing for the petitioners submitted that the redetermination of the compensation has not been done.
4.However, it appears that there is one impediment; the petitioner has not withdrawn the compensation originally fixed and this appears to be the reason for the delay.
5.In the light of the above, petitioners are permitted to withdraw the compensation originally fixed, which is lying in deposit, without prejudice to their rights and contentions and within three weeks from the date of receipt of the said compensation amount by the petitioners, thereafter the respondent shall take steps to redetermine the compensation as ordered by this Court in the writ petition.
6.With the above directions, this Contempt Petition is closed.
To Mr.M.Karunakaran, IAS, The District Collector, Tirunelveli District..
