JUDGMENT / ORDER

The learned counsel for the revision petitioner fairly states that the revision is not maintainable, as against the order of acquittal passed by the Sessions Court. Accordingly, the learned counsel seeks permission of this Court N.SATHISH KUMAR, J., kas to withdraw the revision petition with liberty may be given to him to file an appeal. He has also made an endorsement to that effect.
2. The said endorsement is recorded. The petitioner is permitted to withdraw the revision petition with liberty to file an Appeal before the Appellate Court along with necessary application, under Section 14 of Limitation Act. It is made clear that the period of pendency of this revision before this Court shall be taken into account by the Appellate Court.
3.With the above observation, this petition stands dismissed as withdrawn.
