THIS PETITION COMING ON FOR PRELIMINARY HEARING IN ‘B’ GROUP THIS DAY, THE COURT MADE THE FOLLOWING:-
ORDER Sri Mahesh K.N. for Sri Murthy Dayanand Naik, learned Counsel for the petitioner.
Sri Adithya Singh, learned Central Government Counsel for the respondent.
2. The petition is admitted for hearing. With the consent of learned counsel for the parties, the same is heard finally.
3. In this petition under Article 226 of the Constitution of India, the petitioner inter alia seeks to direct the respondent to renew the passport issued to the petitioner.
4. When the matter was taken up today, learned Counsel for the petitioner submits that since a criminal case is pending against the petitioner, the passport cannot be renewed in his favour. However, he submits that in case the petitioner submit a representation, the same shall be dealt in accordance with law.
5. In view of the submission made and in the facts of the case, the petition is disposed of with a direction that in case the petitioner submit a representation, the respondent-Passport Officer shall take a decision with regard to renewal of the passport in accordance with law within a period of two weeks from the date on which such a representation which may be submitted by the petitioner.
Accordingly, the petition is disposed of.
