Heard learned counsel for the petitioner and learned Standing Counsel.
In view of the order proposed to be passed, notices need not go to private respondent.
The petitioner is before this Court assailing the order dated 4.7.2018 passed by Civil Judge (JD), Shahar, Jaunpur in Mutfarka No.125 of 2018 (Sri Ram v. Tehsildar, Sadar, Jaunpur).
The Court has proceeded to examine the record in question and does not find any infirmity or illegality in the order impugned so as to make interference under Art.227 of the Constitution of India. However, in the interest of justice, without expressing any opinion on the merits of the issue, the writ petition stands disposed of finally with a direction to lower court to consider and decide the injunction application in the suit in question in accordance with law expeditiously but certainly after giving opportunity to the parties concerned and without granting unnecessary adjournments to either of the parties, except upon payment of cost.
