M.Sreenivasa, Advocate) This Civil Revision Petition is filed under Section 18 of Small Courts Act, against the order Dated 16.11.2018 passed in SC.No.707/2017 on the file of the II Additional Judge, and XXVIII ACMM, Court of Small Causes, Bengaluru, rejecting the application filed under Section 8 and 16 of Karnataka Small Causes Court Act r/w Sec.43 of Karnataka Rent Act r/w Sec.151 of CPC, for direction.
This Civil Revision Petition coming on for admission this day, the Court made the following;
ORDER Learned counsel for the petitioner has filed a memo seeking permission to withdraw this petition with liberty to challenge the final order passed in S.C.No.707/2017, pending before Small Causes Judge, Bangalore.
2. Considering the submission of the learned counsel for the petitioner, memo is placed on record. The civil revision petition is dismissed reserving liberty to challenge the final order if permissible under law.
In view of dismissal of the petition, I.A.No.1/2018 does not survive for consideration and the same stands rejected.
