THIS WRIT PETITION COMING ON FOR ORDERS THIS DAY, THE COURT MADE THE FOLLOWING:
ORDER Petitioner herein is seeking direction to 3rd respondent to complete the enquiry against respondent Nos.4 and 5 with reference to their involvement in the business of Mahaveer Multipurpose Cooperative Societies Limited.
2. It is stated that based on the complaint of the petitioner addressed to 2nd respondent – Joint Registrar of Cooperative Societies on 14.8.2018, proceedings is initiated in No.JRB/Dispute/Section-64/68/2018-19, wherein the 2nd respondent has passed an order on 27.9.2018 in appointing 3rd respondent - Deputy Registrar of Cooperative Societies as Enquiry Officer to look in to the complaint made against respondent Nos.4 and 5 by the petitioner herein. The grievance of the petitioner is that though the said order was passed in August, 2018, till today no progress is made in the matter.
3. In this proceedings, notice to respondents 1 to 3 is served on the learned Additional Government Advocate and notice to respondents 4 and 5 is not yet served. Hence, when the matter came up for orders with reference to issue of notice to respondents 4 and 5, the learned Additional Government Advocate has filed a memo along with copy of letter dated 5.3.2019 issued from the office of the 2nd respondent, wherein it is stated that time stipulated for completion of the enquiry is extended by another six months. In this background, learned Government Advocate would submit that the 3rd respondent would complete the enquiry within 60 days from this day and file appropriate report before the competent authority.
The submission of learned Additional Government Advocate is placed on record.
Accordingly, this writ petition is disposed of.
