… RESPONDENTS THIS WRIT PETITION IS FILED UNDER ARTICLES 226 & 227 OF THE CONSTITUTION OF INDIA, PRAYING TO DIRECT THE R-3 TO RELEASE THE IMPOUNDED DOCUMENT AT ANNEX-A DTD.8.3.2007 WHICH WAS ASSIGNED AS PENDING NO.9893/2006-07 BY ASSIGNING A NEW REGISTRATION NUMBER GIVING THE EFFECT OF REGISTRATION PROSPECTIVELY/ RETROSPECTIVELY AS THIS HON'BLE COURT DEEMS FIT TO GRANT THE RELIEF IN THE CIRCUMSTANCES OF THE CASE & ETC.
THIS WRIT PETITION COMING ON FOR PRELIMINARY HEARING IN ‘B’ GROUP THIS DAY, THE COURT MADE THE FOLLOWING:-
ORDER None for the petitioner Smt.H.C.Kavith, learned High Court Government Pleader for respondents.
Heard.
2. In this petition, the petitioner has prayed for he following reliefs;
a) Issue a writ of mandamus directing the third Respondent to release the impounded document at Annexure ‘A’ dated 8.3.2007 which was assigned as pending No.9893/2006-07 by assigning a new registration number giving the effect of registration prospectively /retrospectively as this Hon’ble Court deems fit to grant the relief in the circumstances of the case.
b) Grant such other relief or reliefs as this Hon’ble Court deems fit to grant in the facts and circumstances of the case, to meet the ends of justice.
c) To award the costs of this Writ Petition.
3. When the matter was taken up today, learned High Court Government Pleader submitted that the document dated 08.03.2007 has not been impounded by the Sub-Registrar and in any case with regard to his grievance, if any, the petitioner shall make an appropriate application, which shall be dealt with in accordance with law.
4. In view of the submissions made and in the facts of the case, the petition is disposed of with a liberty to the petitioner to submit the representation with regard to the grievance, if any, to the Sub-
Registrar. Needless to state that in case such a representation is submitted, the same shall be dealt with in accordance with law.
Accordingly, the petition is disposed of.
