Petitioner has retired from the post of Village Development Officer on 30.9.2016. He has approached this Court with the grievance that only part of the GPF amount has been released and substantial amount of GPF still remains due and payable. Attention of the Court has been invited to a letter dated 26.3.2019, as per which a sum of Rs.3,79,499/- still remains due and payable. It is stated that though sufficient period has expired but entire GPF amount has not been released.
Learned Standing Counsel submits that petitioner's grievance shall be examined by the authority competent, in accordance with law, at the first instance.
Once petitioner has superannuated in 2016, there would be no justification on part of the authorities in not releasing GPF amount within a reasonable period in its entirety. Such amount cannot be withheld even after expiry of three months.
In the aforesaid facts and circumstances, noticed above, this writ petition stands disposed of with a direction upon the respondent no.3 to accord consideration to petitioner's claim and an appropriate order would be passed with regard to release of withheld GPF amount, together with interest in terms of the applicable scheme, within a period of two months from the date of presentation of certified copy of this order.
