1. The Additional Commissioner, Bruhath Bengaluru Mahanagara Palike, (B.B.M.P.) (Properties), N.R. Square, Bengaluru – 560 001.
2. The Additional Chief Secretary, Urban Development Department, Government of Karnataka, IV Floor, Vikasa Soudha, Bangalore – 560 001. …Respondents (By Sri Kempanna, Advocate for R-1; Smt. B.P.Radha, AGA for R-2) This Writ Petition is filed under Articles 226 & 227 of Constitution of India, praying to direct the R-1, to consider the petitions/applications filed as per Annexure-H to H3 by the petitioner for accepting the Katha in his name in the records of the BBMP, in respect of the land bearing old No.53/1 and new Sy. No.53/3 measuring 10 Guntas, situated at Lingarajapura Village, Kasaba Hobli, Bangalore North Tq. (Ward No.86 of BBMP) in accordance with law and etc.
This Writ Petition coming on for preliminary hearing in ‘B’ Group this day, the Court made the following:
ORDER The petitioner claims to have purchased an extent of 10 guntas of land in Sy.No.53/1 of Lingarajapura, Kasaba Hobli, Bangalore North Taluk by a sale deed dated 06.09.2005.
2. The petitioner states that he has approached the respondent – BBMP for entering the name of the petitioner by placing reliance on the sale deed dated 06.09.2005. In this regard, the petitioner has made representations to the respondent – BBMP, the copies of which are produced at Annexures-H to H3 of the petition. The petitioner further states that the said representations have not been considered by the respondent – BBMP till date.
3. Sri Kempanna, learned counsel appearing for the respondent – BBMP advances arguments on the merits of the claim. However, suffice it to say that respondent – BBMP to consider the representations of the petition made at Annexures-H to H3 in accordance with law and such consideration is to be made within a period not later than six weeks from today.
This petition is accordingly disposed of.
