...Respondents This Writ Petition is filed under Articles 226 and 227 of Constitution of India, praying to quash the order dated 23.10.2017 issued by the R-1 marked at Annexure-S.
This Writ Petition coming on for Preliminary Hearing, this day, the Court made the following:-
ORDER In the instant petition, petitioner has assailed the order dated 23.10.2017 passed by disciplinary authority-respondent No.1. He has filed an appeal on 04.12.2017 and it is pending for consideration before the Appellate Authority. Before Appellate Authority considers the petitioner’s memorandum of appeal, he has approached this Court in questioning order of the Disciplinary authority passed on 23.10.2017. Thus, writ petition is pre-mature in respect of challenging the order of disciplinary authority.
Accordingly, writ petition stands disposed of.
Appellate Authority is hereby directed to consider the memorandum of appeal within a period of three months from the date of receipt of this order and communicate the decision to the petitioner.
With the above observation, writ petition stands disposed of.
