THE STATE OF KARNATAKA STATION HOUSE OFFICER NANDI GIRIDHAMA P.S., REP BY GOVERNMENT PLEADER AMBEDKAR VEEDHI BENGALURU-560001 …RESPONDENT (BY SRI HONNAPPA, HCGP.) THIS CRL.P. IS FILED UNDER SECTION 439 OF CR.P.C. PRAYING TO ENLARGE THE PETITIONER ON BAIL IN CR.NO.72/2019 OF NANDI GIRIDHAMA POLICE STATION, CHICKBALLAPURA FOR THE OFFENCE P/U/S 354(A), 448 OF IPC AND SECTIONS 3(1)(w), 3(2)(v-a) OF SC/ST (PREVENTION OF ATROCITIES) ACT, 1989.
THIS CRL.P. COMING ON FOR ORDERS THIS DAY, THE COURT MADE THE FOLLOWING:
2 O R D E R After hearing for some time, it is noticed that the FSL report and the charge sheet has not yet filed in this case. If the charge sheet is not filed within 60 days, the petitioner can definitely avail the relief under Section 167 of Cr.P.C. Further, added to that, after filing of the charge sheet, he can also make necessary application before the Court for grant of bail afresh. In that eventuality, the Trial Court has to consider the bail petition that may be filed either under Section 167 or under Section 439 of Cr.P.C. The same has to be considered as expeditiously as possible.
With these observations, the petition is disposed of.
