Advocate) …Petitioner …Respondents This Criminal Petition is filed under Section 482 of Code of Criminal Procedure praying to quash the complaint dated 22.03.2018, and the FIR in Crime No.116/2018, dated 22.03.2018, registered by the Subramanyapura Police for the offence p/u/s 498A of IPC and Section 3 and 4 of DP Act on the file of the II ACMM, At Bangalore, pending against the petitioner herein.
This Criminal Petition coming on for Admission this day, the Court made the following:
ORDER Heard Sri.Narayana.V.S, learned counsel appearing for petitioner and learned HCGP for the respondent State. Perused the records.
2. The marriage of second respondent and petitioner was solemnized on 23.11.2015 and right from day one of the marriage, there has been discord between petitioner and second respondent herein as alleged that she has been unable to withstand the ill- treatment and harassment perpetrated by the petitioner and unable to face her parents, she was driven to attempt to commit suicide and she consumed certain tablet resulting in being unconscious and was shifted to Government hospital at Jayanagar and her case was registered as medico legal case and later on shifted to Victoria hospital wherein she was inpatient and on being discharged, she filed a complaint on 22.03.2018 narrating sequential date of events as to how she was ill-treated with cruelty both physically and mentally, which resulted in registering a FIR in Crime No.116/2018 against petitioner and four others.
3. On perusal of the complaint allegations it would prima-facie indicate the offence alleged against the petitioner. In fact, investigation is yet to be completed. As such, this Court is of the considered view that it would not be a fit and proper case to interject the investigation or stifle the investigation at the threshold. There is no merit in this case. Accordingly, petition stands dismissed.
