These Writ Petitions are filed under Articles 226 and 227 of the Constitution of India, with a prayer to quash the order dated 03.12.2011 passed by respondent No. 2 vide Annexure G and etc.
These Writ Petitions coming on for Preliminary Hearing in ‘B’ Group this day, the Court passed the following;
O R D E R Sri. D.R. Ravishankar, learned counsel for the petitioners.
Smt. Niloufer Akbar, learned AGA for respondent Nos.1 and 2, Sri G.F. Hunasikatti Math, learned counsel for respondent No.3 and also for proposed respondent Nos.2 to 6, 7 and 11 to 19.
2. The petitions are admitted for hearing. With the consent of learned Counsel for the parties, the matter is heard finally.
3. In these petitions the petitioners inter alia are seeking writ of certiorari for quashing the order dated 03.12.2011 passed by respondent No. 2. Petitioners also seek a writ in the nature of mandamus directing respondent No. 1 to exercise powers under Section 27A(1)(a)(b) of the Karnataka Societies Registration Act, 1960 (hereinafter referred to as `the Act’) and to appoint an Administrator to manage the affairs of respondent No. 3 – society.
4. When the matter was taken up today, learned counsel for the petitioners submitted that the elections in respect of office bearers of the society have not been held since 01.04.1990 and therefore, in view of the provisions contained in Section 27-A of the Act, an Administrator be appointed and the elections be held by the Administrator in accordance with law. It is also urged by the learned counsel for the petitioners that after the expiry of the term, the Administrator alone has the authority to hold elections of the society.
5. On the other hand learned Additional Government Advocate submitted that in pursuance of the order dated 03.12.2011 an enquiry has been held and the enquiry report has been submitted on 13.07.2012. She further submits that in case the elections have not already been held, the same shall be held in accordance with law.

In view of the submissions made and in the facts of the case, I deem it appropriate to dispose of the writ petitions with a direction to the competent authority of the State Government to take a decision with regard to appointment of an Administrator, if the elected body of the society is not in existence and to conduct the election in accordance with law bearing in mind mandate contained in Sections 11 and 27-A of the Act expeditiously.
7. Accordingly, petitions are disposed of.
