SPP for R-1 R-2 served and unrepresented) This Crl.P filed U/S.482 Cr.P.C praying to quash the FIR in crime No.554/2013 Koramangala P.S., Dated:12.11.2013 on the file of the VIII ACMM, Bangalore and etc.
This Criminal Petition is coming on for admission this day, the court made the following:
O R D E R The petitioner is accused No.5 in Cr.No.554/2013 registered for the offences punishable under Section 498A read with Section 3 and 4 of the Dowry prohibition Act.
2. Learned counsel for the petitioner has produced the copy of the order passed by this Court in Crl.P.No.7736/2013 and Crl.P.No.907/2016 whereby the petitions filed by accused Nos.1, 2, 3, 4 and 6 have been quashed on the ground that the complainant and her husband were reunited and the said order reads as under:
“These petitions are disposed of together having regard to the circumstances that the son of the petitioners and his wife have reunited. Therefore, the pendency of the criminal cases would jeopardize such reunion and hence the cases are to be quashed keeping in line with the decision of the Apex Court in the case of Gian Singh vs. State of Punjab and another reported in 2012 (10) SCC 303 followed in the case of Narinder Singh and others vs. State of Punjab and another reported in (2014) 6 SCC 466.”
3. The petitioner is also entitled to the benefit of the said order. As a result, the petition is allowed. The proceedings initiated against the petitioner in Cr.No.554/2013 is quashed.
