Khetty, Adv for R-4) This Writ Petition is filed under Articles 226 and 227 of the Constitution of India praying this Court to direct respondents 1 and 2 to take immediate action of sending the proposal for enhancing the number of Under graduate seats in Government Medical and Dental and ESC colleges in the State of Karnataka for implementing Reservation for Economically weaker section immediately to the respondent No.4 Medical Council of India etc., This Writ Petition coming on for Preliminary Hearing in 'B' Group this day, Devdas J, passed the following:
ORDER The petitioner has filed this writ petition seeking a writ in the nature of mandamus directing the Respondent- State Government to submit proposal to the Medical Council of India for increasing medical seats in Government college /institutions under the 10% Economically Weaker Section reservation scheme for the academic year 2018-19. The Government of Karnataka, according to the petitioners have failed to act upon the repeated reminders/letters issued by Medical Council of India in this regard.
2. Sri Lakshminarayana, learned AGA submits that the State Government has indeed decided to seek for increase of medical seats under 10% Economically Weaker Section reservation scheme and the same in fact has been communicated by letter dated 14.6.2019 written by the Principal Secretary to Government, Health and Family Welfare Department to Secretary General, Board of Governors in Supersession of Medical Council of India. The said communication is taken on record. The submission made by AGA on behalf of Govt of Karnataka is taken on record. Since it has been submitted that present academic year has already commenced, in that view of the matter, it may not be possible for the State Government to implement the scheme for the present academic year. However, it has been undertaken by the State Government before this Court that for the next academic year, the State Government will definitely seek increase in the seats under 10% Economically Weaker Section reservation scheme for the academic year 2018-19. With these observations, the writ petition is disposed off.
