1. Heard learned AGP, Mr.P.P.Banaji for the appellants. Board shows that rule is duly served upon the respondent. However, nobody appears on behalf of the respondent.

It is submitted by learned AGP, Mr.Banaji that the present appeal is covered by the decision of a Division Bench (Coram: Jayant Patel & J.C.Upadhyaya, JJ.) rendered on 22-6-2011 passed in First Appeal No.3753 of 2007 to First Appeal No.3778 of 2007 and allied matters and hence sought to dispose of the present on the same line.
3. It is to be noted that this Court (Coram: Jayant Patel & J.C.Upadhyaya, JJ.) vide common judgment and order dated 22-6-2011 passed in First Appeal No.3753 of 2007 to First Appeal No.3778 of 2007 and allied matters partly allowed the appeals preferred by the State. Since the present appeal is squarely covered by the said common judgment and order dated 22-6-2011 passed in First Appeal No.3753 of 2007 to First Appeal No.3778 of 2007, this appeal is also partly allowed of the same line. No order as to costs.
