Maganbhai Khodabhai Patel, petitioner, has filed this petition with a prayer for issuance of a writ of certiorari or any other appropriate order or direction quashing and setting aside the judgement and order passed by the Gujarat Co-operative Tribunal dismissing appeal No. 443 of 2000 vide order dated 14.9.2004 at Annexure-A whereby it has confirmed the judgement and order of Board of Nominees Court at Rajkot in Lavad Case No. 602 of 1997 vide order dated 12.6.2000. The aforesaid petition was filed on 7.12.2004. On 13.12.2004 this Court issued notice and granted stay against execution of decree on condition that the petitioner has agreed to credit the principal amount from his provident fund account. Thereafter this Court also passed further order dated 30.12.2004. As per the said order it appears that the Court has passed order dated 23.12.2004 and ultimately by virtue of the earlier order as well as the order dated 30.12.2004, interim relief was granted on condition that the petitioner credits the principal sum from his provident fund account. Today when the matter was called out Mr. Vasu, learned advocate, appeared. I am told that the respondent is served but nobody appears on behalf of the respondent. In view of the same, the matter is adjourned to 31.1.2005. Interim relief which has been granted earlier to continue till then. The petitioner will file necessary affidavit regarding service of notice on the respondent.
