JUDGMENT / ORDER

(Per : HON'BLE MR.JUSTICE A.R.DAVE) The petitioner has approached this court with an apprehension that her building might be demolished by respondent No. 3.
2.In pursuance of notice issued by this court, an affidavit-in-reply has been filed by respondent No. 3 stating that there is no drive for demolition or removal even of unauthorised or illegal construction.
3.In view of the fact that as per the petitioner's case her construction has been put up in an absolutely legal manner, there is no question of demolition of her premises.
4.In view of the aforesaid statement made in the affidavit-in-reply, learned advocate Shri Gohil seeks permission to withdraw this petition. Permission granted. The petition stands disposed of as withdrawn. Notice is discharged. Ad-interim relief granted earleir stands vacated.
5.If it is found by respondent No. 3 that the construction put up by the petitioner is illegal or unauthorised, it would be open to the respondents to take appropriate action in accordance with law, after issuance of requisite notice to the petitioner.
