Necessary correction be carried out during course of the day.
Heard learned counsel for the petitioner and Sri Ashok Kumar Singh, learned counsel representing the newly impleaded respondent no.27.
The dispute, in this writ petition as well as in the connected writ petitions, is arises out of the induction of certain alleged members and thereafter the parallel election was held.
Admittedly factual disputes are involved in these petitions which is not disputed by learned counsel for the parties, hence it would be appropriate to remand the matter back to the prescribed authority to adjudicate the proceeding afresh, after providing opportunity of hearing to the respective parties and pass an appropriate order, strictly in accordance with law, preferably within a period of three months from the date of production of the certified copy of this order.
Learned counsel for the respondent is pointing out that fresh elections are held during the pendency of this petition. This aspect will also be considered by the prescribed authority while proceeding in the matter.
All the above writ petitions are accordingly disposed of.
Till the final disposal of the proceeding by the prescribed authority or till 30th May, 2019, whichever is earlier, the status quo, as on date, shall be maintained by the respective parties.
