Heard Sri Sandeep Kumar Singh, learned counsel for the applicant, Sri Jai Narain, learned A.G.A. for the State and perused the record.
It has been argued by learned counsel for the applicant that there were five accused persons involved in the present case including the applicant and two injured persons. One injured namely Ankur received simple injury on his elbow whereas the other injured namely Kuldeep received stab wound in his abdomen and at the end of his statement u/s. 161 Cr.P.C, he assigned the role of stabbing to all the accused persons including the applicant. So far as criminal history of the applicant is concerned, it has been explained in para 15 of the affidavit. Applicant is in jail since 08.01.2018.
Learned AGA opposed the prayer for bail and submitted that as per the statement of the injured Kuldeep, the applicant is said to have stabbed him in his abdomen and was responsible for his injuries and the criminal history of the applicant shows that he is also involved in several cases u/s 307 IPC and has misused the liberty of bail granted to him.
Without expressing any opinion on merits of the case and considering the submission advanced, I find no good ground for grant of bail to the applicant Sonu involved in Case Crime No. 796 of 2017 under Sections 324, 307, 504, 506, 120-B I.P.C., Police station Baghpt, District Baghpat.
Accordingly, the bail application is rejected.
However, the trial court is directed to expedite the trial of the aforesaid case and conclude the same preferably within a period of six months from the date of production of a certified copy of this order, if nt already concluded.
