Heard Sri Awadh Bihari Pandey, learned counsel for the applicant, Sri G.P. Singh, learned A.G.A. appearing for the State and perused the record.
This application under Section 482 Cr.P.C has been moved with a prayer to direct the court below to decide the Session Trial No. 226 of 2017 (State vs. Sonu Thakur) arising out of Case Crime No. 620 of 2017 under sections 376, 354 IPC and section 3(2)5 SC/ST Act, Police Station Kalyanpur, district Kanpur Nagar which is pending before the Court of Additional District and Session Judge/Special Judge SC/ST Act, Kanpur Nagar within stipulated period.
It is contended by the learned counsel for the applicant that the applicant is accused in the present case and he is lying in jail since 21.6.2017 and till date only formal witnesses have been recorded by the trial court so far and no witness of fact till date has been recorded, therefore, he has prayed that a direction may be issued to decide the case expeditiously within stipulated time.
I have gone through the order sheet and find that the case was instituted on 24.8.2017 and till date no witness of fact has been recorded.
It is directed that the court below shall make all endeavour to decide this case expeditiously preferably within a period of six months from today, if there is no legal hurdle, without permitting undue adjournments to either side.
With this direction, this application is disposed of without issuing any notice to opposite party no.2 as it is an innocuous order. If the opposite party no. 2 feels aggrieved, he may approach this Court.
