This application under Section 482 Cr.P.C. has been filed for quashing the proceedings of Case No.1380/2019, arising out of Case Crime No.0056/2018, under Section 307 IPC, P.S. Sheeshgarh, Barelly.
It is contended that the parties belong to the same family, there is a property dispute between them, as also a case of no injury, coupled with the fact that informant has submitted an affidavit dated 23.5.2018 (Annexure-5) in support of the applicants.
Learned A.G.A has accepted notice on behalf of O.P. No.1.
Issue notice to O.P. No.2.
Counter affidavit may be filed within a month. Rejoinder, if any, may be filed, within two weeks thereafter.
List in the week commencing 24.2.2020 before the appropriate Court.
Till the next date of listing, further proceedings of Case No.1380/2019, arising out of Case Crime No.0056/2018, under Section 307 IPC, P.S. Sheeshgarh, Barelly, shall remain stayed.
