Heard Sri Ram Babu Singh, learned counsel for the petitioner and the learned standing counsel for the respondents.
Petitioner no.1 claims to have married petitioner no.2. According to the High School Certificate, (Annexure 2 to the writ petition) date of birth of the petitioner no.2 is 16.6.1997 and he is major as on date. So far as petitioner no.1 is concerned it is stated that her High School certificate has been misplaced.
Since the petitioner no.1 claims to be educated and done her High School this is not a case to refer to the Chief Medical Officer for determination of the age of the petitioner no.1.
Learned counsel for the petitioner prays that he may be permitted to withdraw this writ petition with liberty to file a fresh writ petition enclosing therewith the High School certificate of petitioner no.1.
The writ petition is dismissed with the aforesaid liberty.
