Heard Sri Abhishek Gupta, learned counsel for the petitioner and Sri Shekhar Gangal, learned counsel appearing on behalf of Nagar Palika Parishad, Khair, Aligarh.
The petitioner made a complaint to the Chief Minister during Janta Darbar on 24.9.2018 making certain allegations of mis-appropriation of the public fund against the erstwhile Chairman/Executive Officer, Nagar Palika Parishad, Khair and to recover the loss from them.
On the said complaint it appears that the Chief Minister directed for appropriate action in the matter. It further appears that in response to the same a report from Nagar Palika Parishad was obtained and has been placed before the Chief Minister.
The petitioner by means of this petition wants that the enquiry which was entrusted to the District Magistrate in the matter by the order of the Chief Minister be directed to be completed within a time bound period.
We do not find any order of the Chief Minister by which any enquiry in the matter has been entrusted to the District Magistrate. In the Janta Darbar the Chief Minister has only asked for taking appropriate action in regard to which a report from the Nagar Palika Parishad has already been placed on record. It is now upto the Chief Minister or his office to take appropriate action in the matter.
In view of the above, we do not feel necessary to issue any mandamus to the District Magistrate.
The writ petition is dismissed according.
