Heard Sri Vidya Kant Shukla, learned counsel for the appellant and Sri Rajesh Kumar, learned counsel for the respondent-insurance company.
The present appeal has been preferred by the claimant for enhancement of compensation.
This Court on 11.1.2019 passed the following order:
"Learned counsel for the appellant has contended that appellant has filed disability certificate which shows that the appellant has suffered 60% disability. He further submits that the Tribunal has erred in disbelieving the disability certificate issued by the Medical Board. It appears that Tribunal without appreciating the correct facts and evidence on record has disbelieved the disability certificate.
Learned counsel for the appellant very fairly submits that if his client is paid Rs. 50,000/- in lump sum in addition to the amount which has been paid under the order, the claim of the appellant shall be fully satisfied.
The offer made by the learned counsel for the appellant appears to be very reasonable.
Learned counsel for the respondents prays for and is granted three days time to seek instructions from his client.
Put up on 22.01.2019 in the additional cause list."
Sri Rajesh Kumar, counsel for the respondent-insurance company states that the insurance company is ready to compromise the matter and pay Rs.50,000/- in lump-sum in addition to the amount which has been paid under the award to the claimant for full and final satisfaction of the claim of the appellant.
Thus, the present appeal is being disposed of in terms of compromise between the parties and it is provided that the insurance company shall pay Rs.50,000/- in lump-sum in addition to the amount which has been paid to the claimant under the award towards final satisfaction of the claim of the appellant within a period of six weeks from the date of production of certified copy of this order.
