Sompal And Others vs State Of U P And Others

High Court Of Judicature at Allahabad|22 February, 2019
|

JUDGMENT / ORDER

Court No. - 34
Case :- WRIT - A No. - 34957 of 2002 Petitioner :- Sompal And Others Respondent :- State Of U.P. And Others Counsel for Petitioner :- I.H. Farooqui,P.C. Shukla,Rajeshwar Yadav Counsel for Respondent :- C.S.C.
Hon'ble Sudhir Agarwal,J.
1. Called in revise. None appeared to press this writ petition. Learned Standing Counsel is present for respondents. In the circumstances, I myself have perused the record.
2. By means of present writ petition, petitioners have sought following reliefs:
“(a) issue a writ, order or direction in the nature of mandamus commanding the opposite parties to regularise the petitioner on their respective post, without any further loss of time.
(b) issue a writ, order or direction in the nature nature of mandamus commanding the opposite parties to pay the salary to the petitioners at the minimum of pay scale with admissible allowances of the post, with effect from the date of completion of 5 years of their service, in the light of the direction contained in Annexure-6 to the writ petition.
(c) issue a writ, order or direction in the nature of certiorari quashing the condition contained in the letter dated 18.11.1992 (Annexures-3 to the writ petition) that persons taken in service on daily wages after 1.3.1984 would not be taken on permanent muster roll.
(d) issue a writ, order or direction in the nature of mandamus commanding the opposite party no. 2 to decide the representation of the petitioners, contained in Annexure-9 to the writ petition, and to communicate the decision thereon to the petitioners expeditiously.”
3. I myself have gone through the pleadings, grounds as also reliefs sought and find that petitioners are not able to make out a case so as to justify interference of this Court by granting reliefs, as prayed for.
4. Moreover, it appears that either the cause of action no more survives or the petitioners have lost interest in this matter or it has otherwise become infructuous and, probably for this reason, none is interested to have decided this matter on merits and that is why, counsel for petitioners is absent.
5. Dismissed. Interim order, if any, stands vacated.
