This civil revision petition is filed by the petitioner-1st defendant under Article 227 of the Constitution of India aggrieved by the order dated 15.4.2010 passed in I.A.No:500 of 2010 in O.S.No:266 of 2000 on the file of the learned II Additional Junior Civil Judge, Warangal.
By the aforesaid impugned order, the petition filed by the petitioner under order 18 rule 17 C.P.C to recall P.w.1 for further cross examination, is rejected by the Court below.
The Court below in the impugned order has stated that no reasons are stated in the affidavit to recall P.w.1 for further cross- examination. A copy of the affidavit filed in support of the interlocutory application is placed on record. This Court has also perused the same. In the said affidavit, absolutely no reason is given by the petitioner to recall P.w.1 at this stage.
It is stated that P.w.1 was examined in the year 2003 and in the absence of any reasons in the affidavit filed in support of the application, the Court below rightly rejected the application.
This Court is also of the view that there is no illegality in the order passed by the Court below, warranting interference of this Court under Article 227 of the Constitution of India. Hence, this C.R.P is devoid of merits.
This civil revision petition is dismissed accordingly. No order as to costs.
