Heard learned counsel for the petitioner, learned counsel for respondent no.2 as well as learned A.G.A. and perused the record.
The instant writ petition under Article 226 of the Constitution of India has been filed with the prayer to quash the impugned order dated 16.12.2006, passed by Judicial Magistrate Court No.1, District- Muzaffarnagar in Criminal Case No. 414/12 of 2006 and order dated 15.2.2007, passed by Learned In-charge Sessions Judge, Muzaffarnagar, in Criminal Revision No. 74 of 2007 respectively.
Having heard and gone through the record, I do not find any manifest error or otherwise illegality, procedural or otherwise, so as to justify interference in Writ Petition. Moreover, the informant in his statement has clearly assigned specific role to the petitioner.
In view of above, the present writ petition being devoid of merit, is hereby dismissed.
Interim order, if any, stands vacated.
Certify this judgment to the lower Court immediately.
