Heard Shri Chandra Bhan Gupta, learned counsel for the petitioners, Shri Chandan Sharma, learned counsel for respondent no.5 and learned Standing Counsel for the State.
The petitioner is claiming to be tenant of shop of respondent no.5 (Committee of Management Co-operative Ganna Vikas Samiti, Ltd. Khatauli) and have challenged the enhancement of rent.
It is to be noted that there is a provision of arbitration clause. In case, there is any dispute between the petitioner and respondent no.5, the petitioner can invoke arbitration clause. In the writ proceedings, no such direction can be given.
With the aforesaid observation, the petition is dismissed.
