1. The present application is filed by the convict through his son seeking temporary bail for a period of 30 days on the sad demise of his mother-in-law, who died on 22.6.2012.
2. Rule was issued on 2.7.2012 and it was made returnable on 5.7.2012. On 5.7.2012, the matter was adjourned for today. Today also, learned APP is not having any instructions in the matter. It is really a sorry state of affairs that in a case of death, the State takes so much time in verification of the contents of the application.
3. Taking into consideration the fact that the death certificate is annexed with the application and that in the past the convict reported in time on every occasions, and the contents of the application, the same is allowed. The present applicant-convict is ordered to be released on temporary bail for a period of one week from the date of his release on his executing a personal bond of Rs. 5000/- (Rupees five thousand only) to the satisfaction of the Jail authorities.
5. The convict shall surrender himself to the Jail authorities on expiry of the above temporary bail period. The application is allowed. Rule is made absolute. Direct service is permitted.
