Heard Sri Pradeep Kumar Yadav holding brief of Sri Vivek Singh, learned counsel for the petitioners and learned Standing Counsel for the State respondents.
Petitioner no. 1 Smt. Sima is present before the Court and has been identified by her counsel. She is stated to have earlier been married to one Avnish and now wants to marry Hardesh Kumar, petitioner no. 2 as stated in para 11 of the writ petition. Petitioner no. 2 Hardesh Kumar is present in the Court and identified by his counsel.
Both petitioner no. 1 and petitioner no. 2 have been questioned by us and state that they have married each other, and seek protection from this Court. From the High School certificates filed along with the writ petition, we find that both the petitioners are major and the petitioner no. 1 is more than 24 years old.
We, therefore, dispose of the writ petition with a direction to the respondent no. 2 & 3, Superintendent of Police, District Firozabad and Station House Officer, P.S. Fariya, District Firozabad respectively to ensure that the petitioners no. 1 & 2 are not harassed if they want to live together.
