JUDGMENT / ORDER

1. The learned counsel for the applicant submitted that the applicant had undergone substantial period of imprisonment Considering the submissions made as also looking to the nature of allegations in the FIR, I am of the opinion that the applicant is required to be released on bail. Under the circumstances, the applicant is ordered to be released on bail in connection with the FIR bearing C.R. No. I-1124/2004 lodged before Navrangpura Police Station on furnishing bond of Rs.10,000/- [Rupees Ten thousand only] and one surety each of the like amount and on conditions that they shall ;
[a] not take undue advantage of their liberty or abuse their liberty;
[b] not act in a manner injurious to the interest of the prosecution;
[c] maintain law and order;
[d] mark their presence before concerned Police Station on 1st Sunday of every month month between 11.00 a.m. and 2 p.m .
[e] not leave Ahmedabad District without prior permission of the Sessions Judge concerned;
[f] furnish address of their residence at the time of execution of the bond and shall not change the residence without prior permission of this Court;
[g] surrender their passport, if any, to the Lower Court immediately.
3. If breach of any of the above conditions is committed, the Sessions Judge concerned will be free to take appropriate action in the matter.
4. Bail before the Lower Court having jurisdiction to try the case.
5. Rule is made absolute. Direct service is permitted.
