By its Secretary, Agriculture Dept., Secretariat, Hyderabad and two others …Respondents Counsel for the petitioners : Sri S.Syam Sundara Rao Counsel for respondent No.1: G.P for Agriculture Counsel for respondent No.2: Sri Deepak Bhattacharjee Counsel for respondent No.3: None appeared The Court made the following THE HON’BLE MR. JUSTICE C.V.NAGARJUNA REDDY WRIT PETITION Nos.14573 & 15846 of 2007
COMMON ORDER:-
In these writ petitions, the petitioners have challenged deduction of crop insurance premium from the crop loans released/to be released to them as illegal.
At the hearing, it is represented by the learned Assistant Government Pleader for Agriculture appearing for respondent No.1 and the learned Standing Counsel appearing for the Agricultural Insurance Company of India Limited that these writ petitions are liable to be dismissed for two reasons, namely; that the Khariff and Rabi crop seasons of 2007 and 2008, for which the writ petitions are filed, have already been over and that the issues raised in these writ petitions are squarely covered by the judgment of the Division Bench of this Court in Andhra Pradesh Rythu Sangham v. Union of India and others[1].
Having carefully perused the record, I find merit in these submissions of the learned counsel. As the crop seasons of 2007 and 2008 have been over, the cause in these writ petitions does not survive for consideration. In any event, the Division Bench in the above said judgment upheld the validity of the crop insurance scheme. Therefore, on both these grounds, these writ petitions are dismissed.
As a sequel to dismissal of the writ petitions, interim orders dated 10.07.2007 and 26.07.2007 in WPMP Nos. 18299 and 20095 of 2007 in WP.Nos.14573 and 15846 of 2007 respectively are vacated and WPMPs are disposed of as infructuous. WVMP Nos.2835 and 2783 of 2007, in WP.Nos.14573 and 15846 of 2007 respectively are also disposed of as infructuous.
