This writ petition is filed by the petitioner (total 95 in number) with a prayer to quash the order dated 11.9.2015 passed by the DIOS, Meerut. No interim order is granted to the petitioner by this Court. The DIOS by order dated 11.9.2015 has directed as follows :
"ननिष्कररर उपररोक्त सममीकक्षा कके आलरोक मम स्पष्ट हरोतक्षा हहै नक सरोसक्षायटमी रजजिस्टटकेशनि एक्ट कके अनिनुसक्षार बनिक्षायके गयके 180 सदस्य नविदक्षालय ककी सक्षाधक्षारण सभक्षा कके सदस्य निहहीं बनिक्षायके जिक्षा सकतके। उभय पकक्षों तथक्षा प्रस्तनुत तथ्यक्षों कके आधक्षार पर विरर 2008 मम सम्पन्न करक्षायके गयके चनिक्षावि मम प्रनतभक्षाग करनिके विक्षालके कनु ल 98 सदस्य (88 आजिमीविनि +10 सक्षाधक्षारण सदस्य) मम सके जिमीनवित सदस्यक्षों मम सके चनुनिक्षावि करक्षायक्षा जिक्षानिक्षा उनचत हरोगक्षा। ननिणरयर उपररोक्तक्षानिनुसक्षार उभय पकक्षों ककी सनुनिविक्षाई कके उपरक्षान्त सरोसक्षायटमी रजजिस्टटकेशनि एक्ट 1860 कके अन्तगरत बनिक्षायके गयके 180 सदस्य (मक्षानिनिमीय न्यक्षायक्षालय मम नविविक्षानदत) करो नविदक्षालय ककी सक्षाधक्षारण सभक्षा कक्षा सदस्य निहहीं मक्षानिक्षा जिक्षा सकतक्षा हहै। विरर 2008 मम सम्पन्न हहए ननिविक्षारचनि मम प्रनतभक्षागमी 98 सदस्यक्षों मम जिमीनवित सदस्यक्षों सके चनुनिक्षावि करक्षायके जिक्षानिके ककी शमी ब्रहमविमीर जससिंह ककी मक्षासिंग करो स्विमीकक्षार करतके हहए उनिकक्षा प्रत्यक्षाविकेदनि नदनिक्षासिंक 13.08.2015 ननिस्तक्षाररत नकयक्षा जिक्षातक्षा ह।है "
During the course of hearing of this petition and connected writ petitions this Court came to know that the original suit has been filed by Shyam Singh and 94 others before the Court of Civil Judge (Jr. Division) Sardhana, Meerut being Original Suit No. 58 of 2012. An application for injunction being Application No. 101 of 2012 was filed by the petitioner Brahmavir Singh was rejected by the Court below vide order dated 23.7.2015.
Learned counsel for the parties are agreed that pending suit before the Court below be expedited.
It is noticed that the controversy in all the connected writ petitions are raised by either of the parties step by step ignoring that the issue is pending before the Civil Court as Original Suit No. 58 of 2012.
As agreed, this Court directs the Civil Court namely Civil Judge (Jr. Division) Sardhana, Meerut to expedite the suit no. 58 of 2012 and decide the same expeditiously preferably before 30th May 2019 in accordance with law. It is made clear that no unnecessary adjournment will be allowed to either of the parties.
Learned counsel for the petitioners has not disputed that this writ petition has become infrucuous by passage of time.
In view of the aforesaid the writ petition is dismissed.
