Heard learned counsel for the petitioners and Shri Pankaj Rai, learned Addl. Chief Standing Counsel.
The petitioners are before this Court for a direction to the respondent to demarcate the land of the petitioner on the plot in question and hand over the possession to them.
Learned Standing Counsel has informed to the Court that the petitioners have already filed application for demarcation in response to the order dated 20.2.2018 passed in Writ-C No.4369 of 2018 (Shyam Prakash v. State of U.P.) and there is no inordinate delay in its decision and as such no reprieve may be accorded to the petitioner.
Considering the facts and circumstances of the case, this Court is of the considered opinion that in case the petitioner has moved the application for demarcation of the property in question pursuant to order dated 20.02.2018 passed in the aforesaid writ petition, in such situation, it is incumbent upon the respondents to ensure that the proceeding may be finalised expeditiously.
The writ petition is disposed of accordingly.
