Heard learned counsel for the petitioner and the learned Standing Counsel.
This petition challenges an order dated 6 July 2016 in terms of which the petitioner had come to be suspended from service consequent to his incarceration for a period of more than 24 hours in connection with a criminal case. This suspension order has continued till date. Learned counsel for the petitioner has drawn the attention of the Court to the order of the Division Bench dated 29 May 2018 in terms of which the petitioner has now been enlarged on bail.
In any view of the matter, it is his submission that the respondents are obliged statutorily to consider revocation of the order of suspension since the same cannot continue indefinitely. Additionally, an issue has been raised with regard to non- payment of subsistence allowance for the entire period during which the petitioner remained under suspension.
Learned counsel appearing for the second respondent states that this claim shall be duly considered and disposed of by the District Magistrate concerned in accordance with law within a period of one month from the date of presentation of a certified copy of this order along with a copy of the writ petition and its enclosures.
In light of the statement so made, which is recorded and accepted, nothing further survives on this petition, which shall in consequence stand disposed of.
